Technology, Data and AI

Kenya now has a national AI strategy, an active data protection regulator, a contested cybercrimes law and an AI bill before the Senate. Institutions that automate decisions or hold personal data face binding and tightening obligations. We help leaders govern technology with evidence, meet the law and prove that digital services work.

The policy environment

Kenya's technology governance rests on a small number of statutes that now carry real weight. The Data Protection Act, 2019 and its 2021 regulations require registration with the Office of the Data Protection Commissioner, impact assessments for high-risk processing and safeguards on automated decisions. The Kenya Artificial Intelligence Strategy 2025-2030, launched in March 2025, sets three pillars, digital infrastructure, data, and research and innovation, supported by governance, talent, investment and ethics. It sits within the Kenya National Digital Master Plan 2022-2032. The strategy itself records that Kenya has no AI-specific law. The Artificial Intelligence Bill, 2026, a Senate bill listed for second reading by June 2026, would create an AI Commissioner and a risk-tiered regime.

Enforcement and litigation are shaping obligations faster than legislation. The Data Commissioner has issued hundreds of determinations, enforcement notices and compensation orders, and in May 2025 the High Court ordered Worldcoin to delete biometric data collected without an adequate impact assessment under section 31 of the Act. The Computer Misuse and Cybercrimes (Amendment) Act, 2025 widened investigative powers and duties on service providers, but in July 2026 the High Court struck down its website-blocking power and its expanded cyber harassment offence. In finance, the Central Bank of Kenya surveyed AI use in 2025, found most institutions without an AI strategy, and in September 2026 opened consultation on revised prudential guidelines and guidance notes, including a draft note on AI in banking.

Digital public infrastructure is expanding through eCitizen, the Maisha Namba unique personal identifier and the Digital Health Act, 2023, whose 2025 regulations govern health information management and data exchange and build on the Act's requirement for county health data banks. A 2025 special audit by the Auditor-General questioned the traceability of eCitizen payments, and the data-sharing terms of the December 2025 Kenya-United States health cooperation framework remain before the courts. The draft National Data Governance Policy, consulted on in 2026, proposes data officers in every ministry, agency and county and a national data marketplace. The Technopolis Act, 2026 turns Konza's authority into a national Technopolis Development Authority. For counties, the question is no longer whether to digitise but how to govern what they hold.

Where the pressure is

The decisions in front of Kenyan institutions now.

Reviewed October 2026. Each pressure traces to a law, a policy or a ruling set out below.

01

AI Bill would impose risk-tiered duties

The Artificial Intelligence Bill, 2026 proposes an Office of the AI Commissioner, a ban on unacceptable-risk systems, and impact assessments, registration and human oversight for high-risk uses in health, education, finance, security and public administration. Institutions that inventory their systems and document their decisions now will absorb the law at lower cost, whatever its final form.

02

Data protection enforcement has reached operations

The Data Commissioner now issues determinations, penalty notices and compensation orders, and the courts have treated a missing impact assessment as fatal, as in the May 2025 Worldcoin judgment. Boards need to know which processing requires an assessment, whether their registration is current and how quickly a breach can be reported.

03

Cybercrimes law in flux after 2026 judgment

The July 2026 High Court judgment removed the website-blocking power and the expanded cyber harassment offence introduced in 2025, while the rest of the amendment stands. Public institutions and service providers need clear advice on which obligations bind them and how to handle investigators' data requests lawfully.

04

AI credit decisions under supervisory scrutiny

CBK's 2025 survey found credit risk assessment to be the leading use of AI among respondents, and most institutions without an AI strategy. Lenders now face explicit expectations on human oversight, explainability and bias, and CBK's consultation on revised guidelines and guidance notes, including a draft note on AI, runs to 7 November 2026.

05

Health data sharing tests the Digital Health Act

Counties must operate health data banks and integrate facility systems under the Act and its 2025 regulations, while litigation over data sharing under the Kenya-United States health cooperation framework continues. Ministries, counties and partners need evidence that digital health systems protect patients and improve care.

06

Public data governance and platform accountability

The draft National Data Governance Policy proposes data officers in every county and a paid marketplace for anonymised government data, and the Auditor-General's 2025 special audit questioned the traceability of eCitizen payments. Accounting officers will be asked to show who holds which data, on what lawful basis and under what controls.

Laws, plans and institutions

The framework that governs the sector.

The Acts and regulations that create obligations, the policies and programmes that set direction, and the institutions that hold the mandate.

Acts and regulations

Data Protection Act, 2019
Establishes the Office of the Data Protection Commissioner, the principles of lawful processing and data subject rights, and requires registration, impact assessments for high-risk processing (section 31) and breach notification. It also restricts decisions based solely on automated processing (section 35), which makes it the main legal constraint on AI systems that use personal data.
Data Protection (General) Regulations, 2021
Set rights-request timelines, data protection by design, the processing that requires an impact assessment (including biometric data and automated decisions with significant effects) and notifiable breaches; regulation 26 requires processing for strategic state interests such as civil registration, public finance and health care to run on servers in Kenya or keep a copy in a Kenyan data centre. Companion instruments, the Data Protection (Registration of Data Controllers and Data Processors) Regulations, 2021 and the Data Protection (Complaints Handling Procedure and Enforcement) Regulations, 2021, govern registration thresholds and enforcement.
Computer Misuse and Cybercrimes Act, 2018 and Computer Misuse and Cybercrimes (Amendment) Act, 2025
The 2018 Act establishes the National Computer and Cybercrimes Co-ordination Committee, protects critical information infrastructure and defines cyber offences and investigation powers. The 2025 amendment, signed in October 2025, tightened service providers' duties to preserve and disclose data on lawful order, but in July 2026 the High Court declared its website-blocking power and expanded cyber harassment offence unconstitutional.
Kenya Information and Communications Act, 1998
The framework statute for telecommunications, broadcasting, postal services and electronic transactions, administered by the Communications Authority of Kenya, covering licensing, SIM registration, electronic signatures and the Universal Service Fund. The Ministry is validating revised sector regulations under the Act in 2026.
Digital Health Act, 2023
Creates the Digital Health Agency as custodian of health data, the Comprehensive Integrated Health Information System and national and county health data banks, with consent, retention and breach rules for health data. The Digital Health (Health Information Management Procedures) Regulations, 2025 and the Digital Health (Data Exchange Component) Regulations, 2025 now set the operating rules for facilities and counties.
Business Laws (Amendment) Act, 2024
Extended Central Bank of Kenya licensing from digital lenders to all non-deposit-taking credit providers. The implementing regulations, which replace the Central Bank of Kenya (Digital Credit Providers) Regulations, 2022, require human oversight, explainability and bias controls where lenders use AI, and prompt reporting of significant cyber incidents.
Technopolis Act, 2026
Signed in May 2026, it converts the Konza Technopolis Development Authority into a Technopolis Development Authority with a national mandate to plan, develop and regulate technology cities, and creates a dispute resolution tribunal. Counties are represented on its board through the Council of Governors and partner on land use and services.

Policies, strategies and programmes

Kenya Artificial Intelligence Strategy 2025-2030
Launched on 27 March 2025 by the Ministry of Information, Communications and the Digital Economy, it rests on three pillars (AI digital infrastructure, data, and AI research and innovation) with governance, talent, investment and ethics as enablers. It commits government to a stronger legal and regulatory framework for AI and to AI in public service delivery, health, agriculture and education.
Kenya National Digital Master Plan 2022-2032
The ten-year blueprint organised around digital infrastructure, digital government and data, digital skills, and innovation and enterprise, implemented with the ICT Authority and sector agencies. It frames national investment in connectivity, government platforms and skills.
National Cybersecurity Strategy 2022
Issued by the National Computer and Cybercrimes Co-ordination Committee, it sets six pillars, from governance, laws and standards to critical information infrastructure protection and cyber risk management, with implementation timelines running to June 2027. It provides for a mid-term review after three years and a final review after five.
Draft National Data Governance Policy (2026)
Validated in February 2026 and issued as a draft final text for consultation in May 2026, it would create a national data governance council, a Data Governance Office, data officers and committees in every ministry, agency and county, and a government marketplace for anonymised datasets. Adoption would add a new tier of obligations for public data holders.
Maisha Namba and eCitizen
Maisha Namba assigns each citizen a unique personal identifier from birth, intended to serve as the birth certificate, national identity, tax and social security number. eCitizen is the government's single gateway for paying for and accessing public services and has drawn audit scrutiny over payment traceability.
