Health

Kenya rebuilt its health financing architecture in 2023 and has spent the years since making it work. We give ministries, counties, contracted providers and funders the economic analysis, verification and digital health evidence they need to decide what to fund, how to pay for it and whether it works.

The policy environment

Kenya's health system now rests on four statutes assented to in October 2023. The Social Health Insurance Act, 2023 replaced the National Hospital Insurance Fund with the Social Health Authority (SHA), which manages three pools: the Primary Healthcare Fund, the Social Health Insurance Fund, and the Emergency, Chronic and Critical Illness Fund. The Primary Health Care Act, 2023 organises services into primary health care networks anchored on community health units and community health promoters. The Digital Health Act, 2023 created the Digital Health Agency as custodian of health data and of a single integrated health information system. The Facilities Improvement Financing Act, 2023 lets public facilities retain the revenue they earn, to supplement rather than replace county budget allocations.

Health is split sharply between the two levels of government. The Fourth Schedule to the Constitution of Kenya, 2010 assigns health policy and national referral health facilities to the national government, and county health facilities, pharmacies, ambulance services and the promotion of primary health care to the 47 counties. The Ministry of Health sets direction under the Kenya Health Policy 2014-2030 and oversees the national agencies: SHA as purchaser, KEMSA as supplier of health products, the National Cancer Institute of Kenya, and the National Syndemic Diseases Control Council, which coordinates the response to HIV, tuberculosis, malaria, sexually transmitted infections and related conditions. Counties run public facilities up to county referral level, appoint community health promoters and co-finance their stipends with the national government.

Implementation has been contested from the start. In July 2024 the High Court declared the Social Health Insurance, Primary Health Care and Digital Health Acts unconstitutional for inadequate public participation; the Court of Appeal stayed that judgment in September 2024, and the appeal was still being heard in late 2025. SHA began operating in October 2024 and has since faced provider protests over delayed payments, disputes over the settlement of verified NHIF legacy claims, and fraud cases. In 2026 SHA made Digital Health Agency certification of facility information systems a condition of contracting. The Quality Healthcare and Patient Safety Bill, 2025, passed by the National Assembly in June 2026, is now before the Senate and would create a single authority to license, accredit and inspect health facilities.

Where the pressure is

The decisions in front of Kenyan institutions now.

Reviewed October 2026. Each pressure traces to a law, a policy or a ruling set out below.

01

SHA provider payments and NHIF legacy claims

Delayed reimbursements have strained hospital cash flow, and some private hospitals have suspended SHA services in protest. SHA is settling verified NHIF-era claims in stages, and many facilities dispute the amounts offered. Hospital boards and county treasuries need claims data they can defend.

02

Constitutional appeal over the 2023 health laws

The Court of Appeal stayed the High Court's July 2024 judgment pending appeal, so the Social Health Insurance, Primary Health Care and Digital Health Acts remain in force. The appeal had not been determined by late 2025, leaving a residual legal risk that funders should weigh in long-term commitments.

03

Certified digital systems as a contracting condition

SHA now requires facilities to run health management information systems certified by the Digital Health Agency to contract for the 2026 to 2028 cycle, with the compliance deadline extended to 30 September 2026. Facilities without compliant systems risk exclusion from SHA-funded schemes.

04

Quality Healthcare and Patient Safety Bill, 2025

Passed by the National Assembly in June 2026 and before the Senate Standing Committee on Health, the Bill would create a Quality Healthcare and Patient Safety Authority to license, accredit and inspect facilities, and a Health Care Tribunal. Facilities would need quality improvement programmes, incident reporting and professional indemnity cover.

05

HIV and syndemic financing transition

The withdrawal of United States government funding disrupted HIV services in many facilities in 2025, and the Kenya AIDS Integration Strategic Framework 2025-2030 sets a goal of full domestic financing of the HIV response by 2030. Costing integrated syndemic services and moving them into SHA benefit packages and county budgets are now live decisions.

06

Commodity security and KEMSA reform

The October 2025 directive to restructure KEMSA targets drug availability in public hospitals. Counties must decide how much to procure through KEMSA, and stock-outs undercut the services SHA purchases.

Laws, plans and institutions

The framework that governs the sector.

The Acts and regulations that create obligations, the policies and programmes that set direction, and the institutions that hold the mandate.

Acts and regulations

Social Health Insurance Act, 2023
Establishes the Social Health Authority and its three funds, makes registration and contribution mandatory and replaced the National Hospital Insurance Fund. It governs contributions, benefits and provider contracting, so most public health purchasing decisions now run through it.
Social Health Insurance Regulations, 2024
Give operational effect to the 2023 Act and were amended by the Social Health Insurance (Amendment) Regulations, 2025. The healthcare service tariffs made under the Act were revised again by Legal Notice No. 78 of 2026, changing what SHA pays providers.
Primary Health Care Act, 2023
Organises primary care into networks of a level four hub and level two and three spokes linked to community health units, and requires counties to appoint, train, equip and pay community health promoters. It defines the service platform that the Primary Healthcare Fund purchases from.
Digital Health Act, 2023
Creates the Digital Health Agency as custodian of health data and requires a comprehensive integrated health information system with national registries, secure data exchange and certification of digital health solutions. Its health data rules sit on top of the Data Protection Act, 2019.
Digital Health (Health Information Management Procedures) Regulations, 2025
Legal Notice No. 76 of 2025 requires digital health solutions to be certified by the Digital Health Agency and sets procedures for moving health records into national and county health data banks. Certification now determines whether a facility can contract with SHA.
Facilities Improvement Financing Act, 2023
Allows public facilities from level one to level five to retain and spend the revenue they collect, including insurance reimbursements, through dedicated facility accounts. It moves cash management to facility level and makes county financial controls and reporting decisive.
Cancer Prevention and Control Act, 2012
Establishes the National Cancer Institute of Kenya to advise the Cabinet Secretary, coordinate cancer services and maintain the national cancer register. It is the statutory basis for national cancer coordination and the registry data on which screening investment decisions rely.
Kenya Medical Supplies Authority Act, 2013
Establishes KEMSA as the public agency for procuring, warehousing and distributing health products and technologies. Its performance determines whether public facilities can deliver the services SHA pays for.

Policies, strategies and programmes

Kenya Health Policy 2014-2030
Adopted as Sessional Paper No. 2 of 2017, it sets the long-term direction of the sector toward the highest attainable standard of health. It frames universal health coverage as the organising goal for national and county investment.
Fourth Medium Term Plan 2023-2027
Carries Vision 2030 and the Bottom-Up Economic Transformation Agenda into the health sector, prioritising SHA, the Primary Healthcare Fund and community health promoters. The health sector MTEF report for 2026/27 to 2028/29 translates these priorities into the budget.
Kenya AIDS Integration Strategic Framework 2025-2030
The National Syndemic Diseases Control Council's framework integrates HIV with tuberculosis, malaria, sexually transmitted infections, non-communicable diseases and mental health through shared primary care platforms. It sets a goal of full domestic financing of the HIV response by 2030, including mainstreaming HIV services into SHA benefit packages.
National Cancer Control Strategy 2023-2027
Sets the national agenda for cancer prevention, early detection, diagnosis, treatment and palliative care. It guides cancer investment by the Ministry of Health, counties and partners.
Community Health Promoters Programme
Community health promoters appointed under the Primary Health Care Act, 2023 receive stipends co-financed by the national and county governments since February 2024, together with kits and digital tools. The Ministry of Health has committed to monitoring their performance against service delivery at community level.

Institutions

Ministry of Health
Sets national health policy and standards, oversees the national health agencies and national referral hospitals, and leads intergovernmental coordination with counties on the 2023 reforms.
Social Health Authority (SHA)
The statutory purchaser of health services under the Social Health Insurance Act, 2023, registering members, collecting contributions, contracting facilities and paying claims from its three funds. It is also settling verified NHIF legacy claims.
Digital Health Agency
Established under the Digital Health Act, 2023 as custodian of health data. It runs the integrated health information system, maintains client, facility, provider and product registries, and certifies the digital health solutions facilities must use to contract with SHA.
Kenya Medical Supplies Authority (KEMSA)
The national agency for procurement, warehousing and distribution of health products to public facilities. In October 2025 the President ordered its restructuring to raise drug availability in public hospitals.
National Syndemic Diseases Control Council (NSDCC)
A state corporation under the State Corporations Act, constituted by the National Syndemic Diseases Control Council Order as amended by Legal Notice 143 of 2022, succeeding the National AIDS Control Council. It coordinates the multisectoral response to HIV, sexually transmitted infections, tuberculosis, malaria, leprosy and lung disease.
National Cancer Institute of Kenya
Established under the Cancer Prevention and Control Act, 2012 to advise on cancer policy, coordinate cancer services across counties and maintain the national cancer register.
County departments of health and the Council of Governors
County departments run public facilities up to county referral level, manage Facilities Improvement Financing accounts and appoint community health promoters. The Council of Governors represents counties in intergovernmental negotiation on health financing and staffing.

What we offer

Consultancy built on the policy environment.

Our practices combine to answer the questions this sector raises. Every assignment is scoped to the institution.

  1. Health economics and business cases

We build costed economic and business cases for screening, treatment and service delivery programmes, testing value for money against SHA tariffs and county budgets. Our 2023 Cancer Screening Programme Economic and Business Case for the National Cancer Institute applied this method.

  2. Health financing analysis under SHA

We analyse how SHA contributions, Primary Healthcare Fund purchasing, facility revenue retention and county allocations combine at facility and county level. Our 2025 Economic Analysis of Devolved Health Financing and Service Delivery for the National Syndemic Diseases Control Council anchors this work.

  3. Surveillance and indicator verification

We design and verify indicator frameworks for disease surveillance and programme results, triangulating facility, community and information system data. We built the Syndemic Surveillance and Indicator Verification Framework for the National Syndemic Diseases Control Council in 2024.

  4. Digital health evaluation

We evaluate digital health pilots and systems against the Digital Health Act, 2023, its 2025 regulations and the Data Protection Act, 2019, verifying whether reported indicators match what happens in care. Our 2025 Digital Health Pilot Indicator Verification in maternal care for PATH International informs this service.
